Company Information
Our company, Elegant Welding INC, is registered and does business under the laws of the state of California, with headquarters in San Jose, California. Our team of welders and designers are qualified to carry out high-quality, custom metal structure projects.
Services Offered
We offer custom metal structure design, fabrication and installation services, including: Fences Gates Railings Other specific projects according to the client’s needs Each service will be executed according to the specifications agreed upon with the client and in compliance with the applicable safety and construction standards in California.
Quotations and Prices
Quotes are offered free of charge and are valid for a period of 30 days, subject to adjustment in case of changes in material prices or modifications in the scope of the project. Final prices will be confirmed prior to beginning any work. Once the client approves the quote, a service contract will be generated.
Service Contract
Before starting the project, the client will be required to sign a service contract, which will include: The scope of work Specific materials to be used Estimated delivery time Price and payment terms Policies for changes or modifications to the project
Payments
A down payment of [percentage of down payment] is required before starting work. The remaining balance is due in full upon delivery or installation, unless a specific payment plan has been agreed upon. We accept the following payment methods: credit cards, wire transfers, and checks issued by banks within the United States.
Delivery Time
The delivery time of the project will depend on its complexity and availability of materials. We will endeavour to meet estimated timeframes, but we assume no liability for delays caused by factors beyond our control, such as supply chain issues or adverse weather conditions.
Project Modifications and Changes
Once the project has commenced, any changes or modifications requested by the client must be approved in writing and may incur additional costs. Changes to the original scope may affect the agreed delivery time.
Warranty
We offer a 1-year warranty on all our installations and welding work. This warranty covers manufacturing and installation defects. The warranty does not cover damage caused by misuse, accidents, vandalism, lack of proper maintenance or extreme weather conditions.
Cancellation Policy
The client may cancel the contract at any time prior to the commencement of work. In the event of cancellation, charges will apply for any expenses incurred in preparing the project, such as purchased materials. Cancellation is not permitted once welding work has commenced, and the client must pay the full cost of the project as agreed.
Intellectual Property and Design
Custom designs created by our team are the intellectual property of Elegant Welding INC. These designs may not be replicated or used in other projects without prior written authorization. We reserve the right to use photographs of completed projects in our portfolio and on social media unless the client expressly requests not to do so.
Responsibility and Disclaimer
We are committed to complying with local safety standards and regulations of San Jose and the state of California throughout the manufacturing and installation process. We are not responsible for damage to the client’s property that occurs due to negligence or misuse after delivery of the product. The client is responsible for obtaining any permits or approvals required for installation of the product on their property.
Limitation of Liability
Under no circumstances will we be liable for indirect, incidental, special or consequential damages arising from the use or inability to use our products or services.
Privacy and Data Protection
Personal information provided by clients will be used solely for project management and will not be shared with third parties without consent, except in situations necessary to complete the service, such as coordinating deliveries with third parties.
Jurisdiction and Applicable Law
These terms and conditions are subject to the laws of the state of California. Any dispute arising in connection with the contract will be resolved in the courts of San Jose, California.
